Abstract

This research addresses the topic of fatwa in terms of its definition, controls, methodologies, and rulings, given the great status of fatwa in Islamic law. It is considered one of the most important means of clarifying Islamic legal rulings for people in their acts of worship, transactions, and contemporary issues. The importance of this topic has become more evident in modern times due to the increasing number of emerging issues and the complexity of new matters, which makes it necessary to regulate the methodology of issuing fatwas in accordance with the principles, rules, and objectives of Sharia in a way that achieves people’s interests and prevents harm.

The research explains the concept and reality of fatwa. It also discusses the controls governing the process of issuing fatwas and addresses the methodologies of fatwa, explaining the approach of strictness and the approach of leniency and their effects. It further clarifies the approach of moderation and balance as the methodology that combines adherence to textual evidences and the realization of the objectives of Sharia, while maintaining balance between benefits and harms, and between strict rulings and legal concessions. The research also discusses the rulings of issuing fatwas from the perspective of the mufti and clarifies that its ruling varies according to different circumstances.

The research concludes by emphasizing the seriousness of the responsibility of issuing fatwas, the danger of engaging in fatwa without proper knowledge, the necessity of scholarly and Sharia-based qualification for the mufti, and the importance of adhering to fatwa controls and a balanced methodology that combines understanding textual evidences, considering the objectives of Sharia, and achieving public interests.
