Abstract

This study explores the issues of takhrij (legal extrapolation) in Usul al-Fiqh (Principles of Islamic Jurisprudence) as a methodological tool relied upon by scholars of Islamic legal theory for deriving rulings and interpreting evidence. The research aims to clarify the concept of takhrij, identify its key issues, and analyze the approaches adopted by Islamic legal scholars in addressing these issues through an applied comparative study across various schools of Usul al-Fiqh. The study employs an analytical and comparative methodology, presenting the concept of takhrij among scholars of Usul al-Fiqh, analyzing and comparing the different madhhabs (legal schools), and highlighting areas of consensus and divergence, as well as the impact of these differences on juristic applications.

The study concludes that takhrij serves as an important tool for refining legal reasoning and guiding independent juristic effort (ijtihad). Moreover, the diversity of takhrij methodologies among scholars of Usul al-Fiqh reflects a rich theoretical landscape, with significant implications for the practical branches of Islamic jurisprudence. The research recommends greater attention to takhrij within contemporary studies of Usul al-Fiqh, given its crucial role in renewing ijtihad, regulating legal opinions (fatwas), and encouraging research that bridges takhrij with its applications in comparative fiqh and legal maxims.
